10-Year Manufacturer's Warranty Terms

1. Coverage:
This Limited Warranty (“Warranty”) covers defects in materials and workmanship in products and services provided by BMU Engineering, subject to the terms outlined below.

2. Warranty Duration:

  • BMU Engineering warrants its products and services for 10 years from the date of purchase or installation to the original purchaser or user.

  • Mine site or heavy civil applications involving 30% or more usage on site environments are covered under a 2-year limited warranty due to the extreme operating conditions.

  • All non-BMU Engineering manufactured components are covered by their respective manufacturer warranties. BMU Engineering does not provide a 10-year warranty on third-party components.

 

3. Definitions:

  • Product/Service: The specific product, equipment or solution supplied by BMU Engineering.

  • Defects: Issues resulting from faulty materials or workmanship, excluding damage due to misuse, abuse, normal wear and tear, unauthorized modifications, accidents, or inadequate maintenance.

 

4. Warranty Claims:
To make a warranty claim, the original purchaser must:

  • Provide proof of purchase or installation.

  • Notify BMU Engineering within a reasonable period after discovering the defect.

  • Follow instructions provided by BMU Engineering for assessment, repair, or replacement.
    BMU Engineering, at its discretion, will repair or replace any defective product or part covered under this Warranty.

 

5. Exclusions:
This Warranty does not cover:

  • Damage due to misuse, abuse, or improper use.

  • Accidents, fire, flood, or natural disasters.

  • Unauthorized repairs or modifications.

  • Normal wear and tear.

  • Damage caused by third-party components, accessories, or installation not performed by BMU Engineering.

  • Products used outside the intended purpose or application, including conditions not communicated during the design phase.

 

6. Limitation of Liability:

  • BMU Engineering is not liable for any incidental, consequential, or indirect damages.

  • BMU’s total liability is limited to the original purchase price or service fee paid.

 

7. Non-Transferability:
This Warranty is non-transferable and applies only to the original purchaser or user.

 

8. Governing Law:
This Warranty is governed by the laws of Australia, without regard to conflict of law principles.

 

9. Modifications:

  • BMU Engineering reserves the right to amend or terminate this Warranty at any time without prior notice.

  • Any modification must be in writing and signed by an authorized representative of BMU Engineering.

 

10. Customer Responsibilities:

  • Customers must use and maintain the product as per BMU Engineering’s instructions.

  • Failure to follow maintenance guidelines may void the Warranty.
